Principles of processing and protection of the personal data


1.                      THE CONTENTS OF THEDOCUMENT
1.1.            In this document, you will find information concerning processing of your personal data when using the Earth.Guide (hereinafter referred to as the "Service").

2.                      WHO WE ARE
2.1.           Operator of Earth.Guide is our company Gems s.r.o., located at address Srbska 2186/19, Kralovo Pole, 612 00 Brno, ID: 095 03 277, which is registered in the Business register under the No. C 119 331, which is led by Regional Court in Brno, Czech Republic.

3.                 WHICH SITUATIONS ARECOVERED BY THE DOCUMENT
3.1.           If you have visited our website, or you have registered in our Service, we process some personal data about you, without which we would not be able to, for example, provide this Service to you.

4.                      DATA WE COLLECT
4.1.           We collect the following information while providing the Service:
4.1.1.    Identification data. These data include basic information about yourself, under which you are registered within our application, such as: The name, surname, nickname, identifier etc.
4.1.2.     Contact details. Your contact details include your email, address, if you share it with us, or Your telephone number.
4.1.3.    Portrait, profile photography. The image you select, which shows your likeness, is your personal data, that we process if you choose to use such photo.
4.1.4.    Information on the use of Services. In case the case of usage of our Service, we collect information about you, which relate to places you like, including information about the way you use our Service (such as information about the time of log in, used functions, search, displayed places, if you clicked on them and other interactions with the Service, your location, etc.),also the information about the device you are using to access the Service. We also process data about your preferences and, based on profiling, we record what we can recommend to you.
4.1.5.    Photographs and information on places. If you choose to add your place in our Service, we collect related information, such as location, time, etc. Regarding the fact, that we do not want photographs to include your portrait, based on which we would be able to identify you (and upload of such photography is prohibited in our Terms and Conditions, this restriction does not apply, for example, to photographs with a blurred face or one that is taken from a great distance), your likeness does not belong in this collected personal information.

5.                      HOW DO WE COLLECT YOURPERSONAL INFORMATION
5.1.           We obtain your personal data mainly from you yourself, except for the cases mentioned below, we do not obtain any other information about you from public or non-public sources.
5.2.           If you use third party service to register and log into our Service (e.g. Facebook), we collect, with your permission, some personal data from your public profile (e.g. The photo and name, etc.). You have all this information under your sole control, and you can edit its scope directly in your account on the given social network

6.                      HOW WE USE YOUR PERSONALDATA AND FOR HOW LONG
User account and Service usage, including access to all functions
6.1.            In the case of you creating a user account in our Service, we need some of your personal information, to make it work and make sure, that it is really you. Therefore, we use your personal identification information, your profile photo and also information about the Service usage, on the basis of which we are able to, in your user account, display e.g. Your favorite places
6.2.             In the context of this purpose, we process your personal information, basing on the necessity to fulfill the contract, which was created between you and our company by agreeing to our Terms Conditions . Without this personal data, we would not be able to provide this Service to you. 
6.3.             For this purpose, we process your personal data only for the period of time, for which you use our application, with maximum period being 3 years after you terminate the use of the Service, or by cancelling the user account, unless otherwise specified in Terms.
Adding places
6.4.           In the event, that you decide to add a new place within the scope of our Service, you insert a photo and information about the place in the application, you are providing us with the license(license agreement), that is listed in the Terms Conditions.
6.5.           With this in mind, the processing of the personal data is necessary for the fulfillment of the contract in the form of a license, that you grant us. Without this processing, we would not be able to provide you with our Service to such an extent, as without this information, it would not be possible to meet the requirements of the license.
6.6.             For this purpose, we process your personal data only for the duration of the license itself, and in the event of cancellation of the user account, we anonymize all information that lead to your identification.
Communication with you
6.7.           In the event, that you contact us outside of the normal situation of Service functionality, like when you raise a demand on our company or have an inquiry, we need your personal information in the range of identification data and data of the use of Service, as well as other personal data without which we would not be technically able to communicate with you.
6.8.           This processing takes place on the basis of our legitimate interest or necessity of the contract fulfillment, if the communication concerns thesituations specified in our Terms.
6.9.           For this purpose, we process your personal data only for the time necessary to resolve our communication, no more than 1 year from the last reply.
Enhancing the Service quality
6.10.         We try to improve the Service the best we can, so we can provide our Service in the finest quality, so it best suits your needs. To this end, we need aggregate statistic data to help us better understand, how users utilize our Service and where we have room for improvement. To this end, we process information about how you use our Service.
6.11.         Thisprocessing takes place based onour legitimate interest, which lies in the goal of constantlyimproving our Service and creating the safest possible environment for alltravelers. Without this processing, we would not be able to ensure the constant security of our Service, nor improve our Service to suit you as much as possible.
6.12.         We process your personal data for this purpose only for the period of you using our Service, with a maximum period of 3 years from the termination of the use of our Service.
Sending business messages
6.13.         We want to share great news with you here and there, which is not directly related to the user account and related communication, but which we want to share with you. These can be our news, reminders for events, but also offers from third parties, that can offer you new travel experiences. For this purpose, we process your personal information on your user account, as well as information about our use of Service.
6.14.         We would therefore like to send you an email with such information occasionally – but only if you give us prior consent. Without your consent and the processing of your personal data, we would not be able to send you a message that would be relevant to you
6.15.         We only process your personal data for this purpose until you revoke your consent.
Ads and other sponsored content
6.16.         We would like to enable our partners to help you discover new and interesting places. For this purpose, we enable our partners to add their places,which we would like to show you, based on your usage of the Service. With this in mind, we can show you places that you might like, based on yourprevious activities. In no case, however, do we pass on, sell, or resell or even show your personal data to anyone. Our partners will receive at most aggregated statistical data, based on which it is not possible to identify anyone.
6.17.         This processing takes place on the basis of our legitimate interest for the purpose of direct marketing, on the basis of which we show you sponsored placespreferentially. Without this process, we cannot improve the use of our Service, it does not mean that you cannot put up an objection, which will change the display settings of sponsored posts.
6.18.         We process your personal data for this purpose only for the period of you using our Service, with a maximum period of 3 years from the termination of the use of our Service.

‍7.                      TO WHOM WE MAKE PERSONALDATA AVAILABLE
7.1.           Your personal data will be handled with greatest care, because we carefully guard it and do not pass it onto anyone, unless absolutely necessary. We only make your personal data available in the following cases:
7.1.1.    Other Service users - we only show other information to other users, that you want to be public, i.e. your name, profile photo and the places you add in the Service, including your favorite places;
7.1.2.    Partners and Sponsored Content -As mentioned above, our partners do not have access to your personal information and only receive statistical reports from which it is not possible to trace back to whom the personal information belongs;
7.1.3.    External suppliers - to the maximum extent necessary, our external suppliers have access to your personal data, who take care of the operation of our Service, or help us keep our Service in good condition and still functional.

8.                      WHERE WE STORE PERSONALDATA
8.1.           Your personal data is stored within the European Union and is not transferred outside its borders.

9.                      WHAT ARE YOUR RIGHTS?
9.1.           In connection with the processing of personal data, you have rights, about which we would like to inform you.
9.2.             Right of access. You have the right to obtain confirmation from us, whether we do or do not process your personal information. If we process your personal data, you have the right to access this processed personal data and at the same time the right to obtain a copy of such personal data.
9.3.           Right of correction. We do everything to process only the most up-to-date personal data about you. You also have the right to ask us to correct your personal data if we process it inaccurately.
9.4.           Right of erasure (right to be forgotten). We store your personal data in accordance with what we write in Terms, we immediately delete or anonymize unnecessary data. However, this does not change the fact, that you have the right to delete (or anonymize) your personal data without delay, provided that one of the following reasons is given:
 -      personal data are no longer needed for the given purposes;
 -      you withdraw your consent to the processing of personal data;
 -      you object to a legitimate interest and we will evaluate that this legitimate interest does not outweigh your rights (in the case of marketing purposes based on a legitimate interest, we will delete this information immediately);
 -      the processing was unlawful;
 -      deletion is imposed on us by the law of the Czech Republic or EU law.         However, we do not always have to, or can, comply with your right. In these cases, the processing is necessary:
-      for the exercise of the right to freedom of expression and information;
 -      to fulfill a legal obligation;
 -      on grounds of public interest in the field of public health;
 -      for archiving purposes in the public interest, for scientific or historical research purposes or for statistical purposes;
 -      for the determination, execution, or defense of legal claims.
However, it is quite possible that none of the above will occur at all, so you do not have to worried about us not deleting your personal information.
9.5.           Right to restrict processing. At the same time, you have the right to restrict the processing of personal data in one of the following cases:
-      you deny the accuracy of your personal information, for the time necessary to verify its accuracy;
-      the processing is illegal, you refuse to delete personal data and you require restrictions on their use;
-      we will no longer need personal data for processing purposes, but you will require us to keep it for the purpose of determining, executing, or defending legal claims;
-      raise an objection to a legitimate interest pending the assessment of its legitimacy.
9.6.           Right to portability. Although it sounds strange, if we process your personal data automatically and the processing is based on consent or the need to fulfill the contract, you have the right to so-called portability. The right to portability guarantees that the data you gave to us, will be passed to you in a commonly used machine-readable format or that we will pass this data on to another administrator, whom you will identify for us.
9.7.             Right to object the processing on grounds of legitimate interest. In the event that we process your personal data on the basis of our legitimate interest, you have the right to file a reasoned objection to such processing. In the case of such processing for direct marketing purposes, you do not have to justify the request and we will immediately stop processing your personal data in accordance with the GDPR. In other cases, we have the right to review your objection and assess whether your rights take precedence over our legitimate interests.
9.8.           Right to withdraw consent. If we process your personal data based on consent, you, of course, have the right to refuse and withdraw the consent at any time. In this case, we will no longer proceed with further processing and, if the law does not prevent us from doing so, we will delete your personal data. However, if we process your personal data on the basis of another legal title, we have no obligation (sometimes, we are forbidden to) delete the personal data.
9.9.           The right to lodge a complaint with the Supervisory Authority. Of course, if you believe that we are processing your personal data in violation of the law, you have the right to file a complaint to the supervisory authority, which according to our headquarters is mainly the Office for Personal Data Protection (www.uoou.cz).

10.1.         You can exercise your rights directly in your user account in our Service, or contact us at our e-mail support@earth.guide.

11.1.         Within our Service, which operates on our website, we use Cookies and similar technologies, that allow us to collect information about how our Services is being used. For the information on the use of cookies, see the Cookie Policy.

12.                  HOW WE PROTECT YOURPERSONAL INFORMATION
12.1.         The security of our Service is one of the most important values ​​on the basis of which our Service is being provided. To this end, we make sure that our users feel safe when using our Service. For this reason, we have implemented technical and organizational measures to ensure the constant security of the personal data, that users entrust to us.
12.2.         In the event, that you suspect personal data security or your account being compromised, please let us know as soon as possible.

13.                  FINAL PROVISIONS
13.1.         There is no automated individual decision-making within the processing of personal data.
13.2.         These principles are effective 01.08.2021.
